Southern Health Trust Pays £1.4 Million in Negligence Claims Over Five Years

A Hampshire-based NHS trust has paid more than £1.4 million in mental health negligence claims over the past five years, according to newly released figures. Southern Health NHS Foundation Trust, responsible for delivering mental health services across a large portion of the county, has settled a total of 21 claims related to clinical negligence between 2019 and April 2024.

The financial data, obtained through a Freedom of Information request, reveals that the trust has settled 21 claims out of 36 reported cases of negligence during this period. The total amount paid out stands at £1,444,111, placing Southern Health among the top 15 NHS trusts in terms of claims settled in the past five years.

Legal Costs Add to Financial Pressure

In addition to the direct compensation paid to claimants, Southern Health has also incurred substantial legal expenses. The Trust paid £212,308 in NHS legal costs and a further £874,850 to cover legal fees for claimants, highlighting the considerable financial strain negligence cases place on the organisation.

Despite the significant payouts, representatives from the trust emphasised that patients can generally expect safe and effective care. They reassured the public that efforts are continuously being made to prevent the need for such claims, and when issues do arise, financial compensation is sometimes appropriate.

A spokesperson for the Trust noted that the number of claims and the amount paid out is in line with what similar-sized trusts experience nationally. They also urged patients with any concerns about their treatment to seek assistance through the Trust’s dedicated support services, which are in place to address any issues.

The Trust’s Extensive Reach

Southern Health NHS Foundation Trust provides mental health care across several key sites, including community hospitals in Fareham, Gosport, Lymington, and Romsey. It supports approximately 60,000 people each year through more than 600,000 mental health contacts, serving a population of around 1.5 million.

Given the size and scope of the Trust’s operations, the number of claims is proportionate to the volume of care provided, according to their representatives. The trust also reiterated its commitment to providing the best possible care and ensuring that any lapses are addressed both at a clinical and organisational level.

Widespread Issue Across the NHS

The figures from Southern Health reflect a broader challenge within the NHS. Data shows that over the past five years, the NHS has paid out at least £121 million in negligence claims related to mental health and psychiatry services. These claims span a range of incidents, from treatment delays to more severe outcomes such as patient fatalities.

The largest portion of these claims, amounting to £51 million, relates to incidents of death, while delays in treatment and failures in care account for a further £28 million. Another £18 million has been paid in claims related to self-harm incidents.

Since 2019, 1,127 cases involving deaths of mental health patients have been reported across NHS trusts, with 457 of these cases resulting in settled claims. In total, £51.2 million has been paid out in damages for these cases, making fatalities the most common cause of mental health-related negligence claims within the NHS.

Comparison With Other Trusts

In comparison to Southern Health, some other NHS trusts have experienced fewer claims. For instance, University Hospitals Southampton Trust has had either zero or fewer than five claims filed against it in the same period, according to data from NHS Resolution. This disparity illustrates the differing challenges faced by NHS trusts, depending on the nature and scale of services they provide.

Scrutiny on Mental Health Services

The release of this data comes amidst heightened scrutiny of mental health services within the NHS. A national investigation is currently underway, looking into the care of thousands of mental health patients who died under the care of NHS facilities in one region. The inquiry aims to identify any failings in the system and recommend improvements to prevent future tragedies.

While this investigation does not directly involve Southern Health, it has brought renewed attention to the overall standards of mental health care provided by the NHS. Mental health trusts across the country are facing increasing pressure to improve patient safety and reduce the number of incidents that lead to negligence claims.

As the national conversation around mental health care intensifies, Southern Health NHS Foundation Trust, like others, will likely face continued scrutiny regarding the quality of its services.
